Preamble:
As specified in Article 7 of the Articles of Association, the Governing Body has the power to establish Bye Laws to govern matters relating to the Association. The Governing Body has established an Appeals Board to determine Appeals from decisions of:
• The Accreditation Committee
• The Re-Accreditation Committee
• The Supervision Committee
• The Training Course Recognition Committee
The constitution and operation of the Appeals Board is dealt with in this Bye Law 10.
1.Membership of the Appeals Board
1.1 The Governing Body shall appoint a pool of at least 5 individuals (the “Appeals Board Panel”). A majority of the members of the Appeals Board Panel should be previous members of one of the following committees:
• The Accreditation Committee
• The Re-Accreditation Committee
• The Supervision Committee
• The Training Course Recognition Committee
1.2 The Chairperson of the Appeals Board Panel shall be appointed by the Governing Body from the membership of the Appeals Board Panel.
1.3 3 members from the Appeals Board Panel will be appointed by the Chairperson of the Appeals Board Panel when an appeal is referred and shall be referred to as the Appeals Board in accordance with the procedure outlined in Bye Law 10A.
2.Term of Office of Members of the Appeals Board Panel
2.1 Appointments to the Appeals Board Panel shall be for a period of two years. Members may be reappointed for further periods of two years but no member shall serve on the Appeals Board Panel for more than eight consecutive years at a time.
3. Function of the Appeals Board
3.1 The function of the Appeals Board once appointed by the Chairperson of the Appeals Board Panel, shall be to determine whether or not the correct procedures were followed by the Committee who made the decision being appealed against.
3.2 In carrying out its work the Appeals Board shall take into account all relevant Bye Laws of the Association and shall operate within the terms of the Association’s Constitution and Policies, and of the Association’s Codes of Ethics and Practice.
4. Duties of the Committee
4.1 In its deliberations, the members of the Appeals Board shall attach utmost importance to impartiality, fairness and respect for privacy.
4.2 If any member of the Appeals Board has such knowledge of or connection with any applicant as could cause a conflict of interest or cast doubt on their impartiality, that member has a duty to declare such potential conflict and to step aside from any involvement in the consideration of the appeal.
4.3 If the member refuses to step aside from involvement in the consideration of the appeal, then the Chairperson may remove the member from the process, and the Governing Body in its sole discretion may remove them from the panel.
5. Rights of the Appeals Board
5.1 The rights of the Appeals Board are set out in the procedure outlined in Bye Law 10A.
6. Decisions of the Appeals Board
6.1 Decisions of the Appeals Board are final and binding on all parties.
7. Miscellaneous
7.1 This Bye Law should be reviewed by the Appeals Board and the Governing Body at least every 3 years.
